Education Accountability Act Rulemaking & State Board Conversations
The state board has recently expressed interest in understanding the implications of changes to the school and district performance frameworks. This conversation is separate from but could also connect to rulemaking changes that are required as a result of recent legislation. The Education Accountability Act of 2009 (SB09-163) holds the state, districts, and individual public schools accountable for performance; HB18-1355 modifies Colorado’s accountability law. The resources below help explain the recent legislation along with the board’s discussion topics. Survey for submitting feedback to the State Board of Education and CDE staff on House Bill 18-1355 focus areas. This survey can be taken at any time before rulemaking hearings begin (March 2019 tentatively) and can be taken multiple times. This survey may adjust as feedback is gathered. |

Current version of draft rules for the Education Accountability Act. Changes were made to the previous version of the rules (dated 11.1.18) in sections 6.02-6.05 (to better clarify requirements for district UIPs), sections 9.03-9.06 (to better clarify requirements for school UIPs), and section 11.06 (to simplify the financial reporting requirements so that they better align with the data required to be posted by districts pursuant to HB10-1036, the "Public School Financial Transparency Act”). Draft rules may continue to be revised throughout the rulemaking process until the state board of education votes to approve rules (tentatively scheduled for June 2019). |

Prior version of draft rules for the Education Accountability Act. A change was made to the previous version of the rules (dated 10.18.18) in section 7.04 (requiring the state board to hold Year 5 Performance Watch hearings between Oct. 1st and Jan. 30th, rather than between Oct. 1st and March 30th). Changes were also made in section 10.0, updating some reporting requirements so that they align with statute (i.e., removing references to stability rates and adding in the reporting requirement from HB18-1355 regarding the percentage of students who score at each achievement level on state assessments) and updating the descriptions of the dropout/graduation/truancy/mobility rate calculations, to align with current practice. |
