Title I, Part A Waivers
Attn: Superintendents, Federal Program Contacts, Title I Directors
The USDE has issued draft guidance for applying for waivers for several provisions of NCLB Title I, Part A ARRA funds. As soon as the final guidance is available, CDE will request waivers for the following provisions pertaining to Title I, A ARRA Funds:
1) Twenty percent set-aside for choice transportation and supplemental educational services (NCLB section 1116(b)(10)(A) and 34 C.F.R. § 200.48(a)(2))
2) Ten percent set-aside for professional development for LEAs identified for improvement (NCLB section 1116(c)(7)(A)(iii))
3) Ten percent set-aside for professional development for schools identified for improvement (NCLB section 1116(b)(3)(A)(iii))
4) Calculating the per-pupil maximum allocation for supplemental educational services (NCLB section 1116(e)(6)(A) and 34 C.F.R. § 200.48(c)(1))
Using its authority under ED Flex, Colorado has already issued a statewide waiver for the fiscal requirements of NCLB § 1127(a)-(b) to permit a LEA to carryover more than 15 percent of its total 2009-10 Title I-A allocation, including its ARRA funds, into the 2010-2011 fiscal year and permit such carryover even if a LEA had obtained a carryover waiver in the past three fiscal years.
Pending release of final guidance from the USDE, Colorado will also apply for waivers from the following NCLB related regulations pertaining to regular Title I, Part A Funds:
1) Prohibiting LEAs on improvement from being SES providers.( C.F.R. § 200.47(b)(1)(iv)(B))
2) Requiring LEAs to provide 14 days notice for public school choice. (C.F.R. § 200.37(b)(4)(iv)).

2009 AYP Updates
Attn: AYP Contacts, Federal Program Coordinators, Superintendents
If you need to authorize a new adequate yearly progress (AYP) respondent for your district, download and complete the respondent form posted at http://www.cde.state.co.us/FedPrograms/AYP/index.asp and fax it to Donna Morganstern at 303-866-6637. Remember: Only the AYP ADE Respondent will have access to the 2009 AYP determinations and data.
CDE has scheduled a mix of webinars and in-person AYP trainings (listed below). Webinars will be capped at 15 participants, but more will be added to the schedule as needed. To register for any trainings (either webinar or in-person) e-mail Clara Algiene (algiene_c@cde.state.co.us).

District appeals are due to CDE by Friday, August 28.
