Board affirms parental rights on testing and related data collection

The Colorado State Board of Education approved a resolution on March 11 supporting parents’ right to make choices about their child’s participation in tests and related data collection. 

The board’s resolution strongly discourages actions by school boards or school districts to interfere with parental rights or attempt to influence parents’ decisions about testing or data collection.  

"The Colorado State Board of Education is committed to upholding parent rights on their child’s participation in testing and related data collection," states the resolution.

Board members and Colorado Department of Education staff have received complaints from parents who said they were pressured by their school or district officials to allow their children to take statewide tests.  Current law does not provide guidance to schools on how to handle parent refusals.

State and federal laws require the tests, and the CDE has authority to hold districts and schools accountable for obtaining 95 percent participation among students.  In February 2015, however, the board passed a motion to not hold districts accountable for low participation on the tests due to parent refusals.

The parental rights resolution will be distributed to all school districts, Boards of Cooperative Education Services, and to the members of the General Assembly House and Senate Education Committees.
