State Board of Education votes to appeal Lobato case

The Colorado State Board of Education voted today to take the next steps necessary to appeal the recent Lobato v. State court decision.

The Dec. 9 ruling on the Lobato case declared Colorado’s school funding system underfunded and not meeting the requirement in the Education Clause of the Colorado Constitution of a “thorough and uniform” system of public education.

In its special meeting held this morning, the board voted to authorize the Attorney General to file a notice of an appeal in the Colorado Supreme Court in the matter of Lobato v. State, on behalf of the Colorado State Board of Education.  It also voted to direct Commissioner Robert Hammond to authorize the Attorney General to file a notice of an appeal in the Colorado Supreme Court in the matter of Lobato v. State, on behalf of the Colorado Commissioner of Education.
