State Board Receives Draft Rules On Educator Effectiveness System; Approves Innovation Status For Three Denver Schools

The Colorado State Board of Education this week received draft rules on the implementation of the Great Teachers and Leaders Act or Senate Bill 10-191, the legislation that set in motion the development of the state’s work on improving educator effectiveness. State law requires the state board to “work with the [State Council for Educator Effectiveness] to promulgate rules concerning the planning, development, implementation and assessment of a system to evaluate the effectiveness of licensed personnel.”

The draft rules, which can be found at, suggest a four-tier evaluation rating system for principals and teachers. The ratings are highly effective, effective, partially effective and ineffective. The performance ratings will be assigned based on:

  1. A common statewide evaluation framework.

  2. Multiple measures of professional practice aggregated into a single score.

  3. Multiple measures of student growth aggregated into a single score.

  4. A common statewide scoring matrix applied to the combined scores on professional practice and student growth to determine a performance evaluation rating.

State board members asked many questions of staff, and heard various opinions from interested parties during a time of public input. Future opportunities for public input include August 3, September 14 and October 5, 2011 at 1:30 p.m. each day. All hearings will be held in the state board room of the department. The state board will vote on the rules on November 9, 2011. Many of the questions and discussion items raised at the June 8 meeting will be addressed during a pilot of the new educator effectiveness performance evaluations. CDE is pulling together a group of six districts to provide valuable feedback on the quality of the model system, identify challenges and strengths of the system and suggest refinements. That process starts in the fall and will run through July 2013.

The state board will issue final rules this fall, which will be reviewed by the legislature in early 2012.

Innovation Schools Act Applications

The state board unanimously approved Innovation Schools Act applications for three new Denver schools—High Tech Early College, Denver Center for 21st Century Learning at Wyman and Collegiate Prep Academy—bringing to 13 the number of schools in Denver Public Schools that have been granted innovation status under state law. The Innovation Schools Act (2008) provides a means for schools and districts to gain waivers from state laws, district-level policies and collective bargaining agreements.

“I commend DPS and the local school board on this work,” said Gantz-Berman. “I think the three proposals are solid and strong and once again DPS has shown what can be accomplished.”

Update on CDE’s Early Childhood Assessment System

The state board was also briefed on the early childhood assessment landscape. Jo O’Brien, assistant commissioner of standards and assessment with key staff presented updates on the Results Matter assessment and outcomes, Colorado Basic Literacy Act rules and approved assessments, and the development of a school readiness assessment for kindergarten students.

With the transition to a new state assessment system in 2014, the new assessment system will include a school readiness assessment for kindergartners which takes into consideration the existing Results Matter tools. The state board also called for the revision of the rules for administering the Colorado Basic Literacy Act to ensure alignment with the expectations outlined in the Colorado Academic Standards. In addition to basic literacy, the new system will also include numeracy measures for grades K-3 which will reflect the same instructional values of progress monitoring and early intervention for Colorado’s youngest learners. The state board will make a final decision on these changes in December.

Alternate Achievement Standards for Students with Significant Cognitive Disabilities

O’Brien with Mira Monroe, senior consultant in the CDE’s Office of Standards and Assessment, walked the board through the alternate achievement standards. According to law, the state may, through a documented and validated standards-setting process, define alternate academic achievement standards, provided those standards align with the state’s academic content standards; promote access to the general curriculum; and reflect professional judgment of the highest achievement standards possible. Often referred to as the “1 percent,” approximately 5,000 students in Colorado have significant cognitive disabilities and qualify for the alternative assessment. The state board will be requested to adopt these alternative achievement standards at its board meeting in August. To view the presentation, visit

High School Math Assessment Options

CDE’s Director of Student Assessment Joyce Zurkowski presented the guiding premises regarding a new high school math assessment. The recommendation from staff was to overlap traditional and integrated assessments.

Board Vice Chair Marcia Neal said, “I’m a fan of integrated math, but I tend to think in the long run that I like the traditional approach.”

Zurkowski pointed out that, “…both approaches have been successful. When you look at trends, I think we’ve gone to toward an integration model, but I think it’s been powerful for Colorado students to be able to choose one path versus the other.”

In August the board will weigh in on which high school math design will be included in the state assessment cost study.

The Colorado State Board of Education also:

  • Denied a request from an educator to remove certain information in the educator’s file.
  • Took action on disciplinary proceedings concerning a license, charge number 2007EC28.

  • Took action on disciplinary proceedings concerning an application for an authorization, charge number 2011EC06.

  • Took action on disciplinary proceedings concerning an authorization, charge number 2011EC07.

  • Took action on disciplinary proceedings concerning an authorization, charge number 2011EC08.

  • Took action on disciplinary proceedings concerning a license charge number 2010EC22.

  • Approved a request for a waiver by Arriba-Flagler School District 20 on behalf of East Central BOCES.

  • Approved the recommended 2011 grantees for the Expelled and At-Risk Student Services Grant Program.

  • Approved payments to administrative units under the Exceptional Children’s Educational Act for reimbursement of payments for students in high cost in-district and out-of-district placements or programs, 2009-10.

  • Appointed two members to the Special Education Fiscal Advisory Committee.

  • Approved a waiver request from certain statutes by Aurora Public Schools on behalf of New America School.

  • Approved a waiver request from certain statutes by Colorado Springs School District 11 on behalf of CIVA Charter School.

  • Approved certification of an online program for the Thompson School District on behalf of Thompson Online.

  • Adopted emergency rules for the administration of the Exceptional Children’s Educational Act.

  • Approved notice of rulemaking concerning rules for the administration of the Exceptional Children’s Educational Act.

  • Approved a request for authorization of the Get Smart Schools Alternative Principal Preparation Program.

  • Approved a motion requiring Eaton School District RE-2 to enter into a memorandum of understanding with Hope Online Learning Academy Co-Op

  • Approved a motion requiring Harrison School District 2 to enter into a memorandum of understanding with Hope Online Learning Academy Co-Op.

  • Approved a of notice of rulemaking regarding rules for the administration of a statewide system to evaluate the effectiveness of licensed personnel in school districts and boards of cooperative educational services.
