Recommendations for Charter School Developers

Consider special education and the charter school’s philosophical orientation and mission in relationship to staffing, service delivery, inclusion practices, etc. when writing the proposal and planning the school’s goals and objectives.

Begin to outline and draft special education policies and procedures prior to opening the school. Become knowledgeable about basic laws pertaining to special education identification, placement, and services such as Individuals with Disabilities Education Act (IDEA), Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act (ADA) of 1990.

Contact the charter authorizing district and its special education office to ask about special education policies and procedures currently being implemented.

Contact the state department’s special education office to ask about resources, guidance, and technical assistance for special education compliance.

Determine how special education funding works early in the process of developing the charter school to avoid delays in receipt of funds due to lack of information.

Determine who (the charter school, the district or third parties) will provide special education services prior to opening the school and determine what are the liabilities and responsibilities of each party.

Consider using an outside consultant or hiring a staff person to assist in setting up evaluation teams, procedures, and financial reimbursements.

Be consistent in the delivery of educational services for all students regardless of race, gender, religion, or handicapping condition.
