Motion for Voluntary Stay of Appeal |  Deny
the Motion from the Pueblo 60 Board of Education for a
Voluntary Stay of Appeal Proceedings. Section
22-30.5-107.5(4) requires that the State Board "shall" issue
a decision within 60 days of the filing of the Notice of
Appeal. No provision of 22-30.5-107.5 authorizes the State
Board to stay or otherwise waive the statutorily mandated 60
day timeline in which to issue a decision on the appeal.
Consequently, Pueblo School District 60's motion must be
denied. |

receipt of an anticipated award by the U.S. Department of
