Consolidated Federal Programs Application

On October 28, 2011, the Colorado Department of Education (CDE) requested a waiver from the United States Department of Education (USDE) of the Tydings Amendment with respect to unobligated FY 2009-2010 funds under ESEA State-administered formula program.  On December 8, the USDE granted CDE’s waiver request to extend the spending period for these funds.    The waiver applies to the following funds:

  • Title I, Part A Grants to Local Educational Agencies

  • Title I, Part A Grants to Local Educational Agencies (Recovery Act)

  • Title I, Part B, Subpart 3 Even Start

  • Title I, Part C Migrant Education State Grants

  • Title I, Part D State Agency Neglected and Delinquent Program

  • Title II, Part A Improving Teacher Quality State Grants

  • Title II, Part B Math Science Partnerships

  • Title II, Part D Enhancing Education Through Technology (Ed-Tech) State Program

  • Title II, Part D Enhancing Education Through Technology (Ed-Tech) State Program (Recovery Act)

  • Title III, Part A English Language State Grants, including Set Aside

  • Title IV, Part A Safe and Drug Free Schools and Community Grants

  • State Assessment Grants

Accordingly, LEAs may continue to spend any remaining FY 2009-2010 funds until September 30, 2012 or until funds are depleted, whichever comes first.  Remaining balances may be found on the Grants Fiscal Management website under the Fiscal Year 2009-2010 header at the following address: http://www.cde.state.co.us/cdefisgrant/Grant_Distribution_Reports.htm.
